Terms

Flat Rate Video.com is a marketing instrument of TFG Film & Tape and is hereafter referred to in this document as “TFG”. The term “Client” as used in this document shall refer to the person or company TFG is producing the video for.

A credit card is required at the time of contract signing and before any work can begin.

One half ($499) will be charged to Client’s credit card within 72 hours prior to the day of filming. The final amount, including any options if selected, will be charged upon final approval. Payment in full is required before the video will be hosted on the server and available for Client’s use.

Final approval must be made within five days of all revisions.

The flat rate offer is for a single video of up to ninety seconds in length shot in a single day at a single location. Additional videos will be quoted for separately.

The package includes hosting of the video for a full year. After that time Client can opt to host the video with another service or continue with TFG for a small yearly fee.

Everyone who appears in Client’s video will be required to sign a model release before the filming can begin. This gives TFG permission to use their image and, in some cases, their voice. It is important that all employees and customers are notified ahead of time that filming will be taking place on such and such a day to give them the option of not appearing in the video if they so chose. Children under the age of 18 will also need their parents signed consent. Copies of the release can be downloaded, here.

When the day of filming arrives Client will be required to make available their business location and personnel (employees and others who may be appearing in the video) such that the filmmaking work can proceed in a timely fashion. TFG will make every effort to complete the process with as little disturbance to the operations of Client’s business as possible. It is critical that TFG and Client work together to insure a favorable outcome can be achieved.

Client understands that TFG has reserved a specific day for the filming of Client’s video and should Client cancel in less than 48 hours it will cause a loss of business income to TFG. In such a case, a cancellation fee of $300 will be charged to Client above and beyond the agreed upon cost for the final video.

TFG is fully insured for commercial business liability. In addition, a workers compensation policy is in force for any and all employees provided by our firm. A certificate of insurance can be supplied upon request prior to the filming.

TFG does not and can not control how, where and/or by whom Client’s video is used. Client understands the open nature of the internet encourages some to misappropriate the creative material of others and there is little TFG can do to prevent this from occurring. TFG takes no responsibility for the use or misuse of the video we provide. Client agrees to indemnify and hold TFG harmless against any claims relating to the use or misuse of the video produced for Client by TFG. These include, but are not limited to, claims of privacy infringement, claims of copyright infringement, claims of trademark infringement, claims of libel, claims of slander.

Rates are not agency commissionable.

Each basic package includes:

  • One-on-one, in-person meeting with one of our video producers to discuss your needs and expectations.
  • Up to 5 hours of shooting time at your (single) location to include 25 to 30 separate shots.
  • Time in our High Definition edit suite to conform the location video into a final 90 second production.
  • Suitable background music.
  • Your final approval and up to two revisions.
  • Coordination with your webmaster to get the video up and running correctly.
  • Web hosting of your video for up to one year.
  • A 5% discount will be applied if you will allow us to append our logo to the end of your video.
